INFORMATION WITH THE PROCESSING OF PERSONAL DATA
1. GENERAL INFORMATION ON THE PROCESSING OF PERSONAL DATA (hereinafter referred to as "PD").
Technopol International, a.s., Kutlíkova 17, 852 50 Bratislava, IČO: 357 233 43, registered in OR OS Bratislava I, Section: Sa, Insert number: 1465/B (hereinafter referred to as the "operator"). We follow the rules and therefore the protection of your personal data is important to us. We process PD in accordance with these conditions. By giving your consent to the processing of personal data on the japonskenoze.sk portal, you are giving your consent as a serious and freely given, specific, informed and unambiguous expression of the will of the person concerned (buyer) in the form of an unambiguously confirming act in the sense of Regulation of the European Parliament and Council (EU) 2016/679 of 27. of April 2016 on the protection of natural persons in the processing of personal data and on the free movement of such data, and also according to the provisions of Act no. 18/2018 Coll. of November 29, 2017 on the protection of personal data and on the amendment of certain laws as amended by the operator (hereinafter referred to as "GDPR and the LAW").
2. PURPOSE OF PROCESSING PD
If you have provided us with PD, it will be used for the following purposes:
2.1 E-shop – for the conclusion and fulfillment of the purchase contract, payment processing, product delivery, or the performance of other related activities (such as complaints and other obligations related to legal regulations in the field of consumer protection), concluded via www.japonskenoze.sk between the operator and to the buyer. To process the order, you have provided us with your name, surname, address, e-mail, telephone number and payment method. E-mail and phone contact also serves as a means of communication. An order confirmation will be sent to your e-mail, and you can also track the status of your order. We process personal data on a legal basis (Article 6 /1/b GDPR and LAW). The processing of personal data is necessary for the performance of a contract to which the affected person (buyer) is a party or to take measures before concluding the contract based on the request of the affected person (buyer) (item 2.1) i.e. j. it is a contractual requirement.
2.2 Marketing – for marketing purposes, if you have given consent to the operator by clicking opt in. Marketing purposes include sales support, marketing offers, newsletter, information about products and news. If the customer does not wish to receive these offers, he simply unsubscribes by line, e-mail or in his account. The operator processes personal data based on the consent of the person concerned (Article 6/1/a GDPR and the LAW).
2.3 The purchase can also be made in the operator's showroom. The operator can process PD obtained with the help of camera recording based on the legitimate interest of the operator. These legitimate interests of the controller may provide a legal basis for processing if they are not overridden by the interests or fundamental rights and freedoms of the buyer, taking into account the reasonable expectations of data subjects based on their relationship with the controller. As long as there is a legitimate interest between the operator and the buyer, for example, when there is a relevant and appropriate relationship between the person concerned and the operator, for example, when the person concerned is in the position of a buyer or visitor (future buyer) in relation to the operator, etc. The processing of personal data that is absolutely necessary for the purposes of property protection and health protection of the operator's employees also constitutes a legitimate interest of the relevant data operator.
3. REGISTRATION
The buyer has the opportunity to register on the website www.japonskenoze.sk. The buyer is allowed to buy even without registration. If you decide to purchase through registration, we will process your PD as follows: You protect your account with a password. By logging into your account, you can get information about your orders, you can edit your PD, as well as the newsletter sending settings. Please protect your password, the operator is not responsible for password misuse. By creating an account on the website www.japonskenoze.sk. you agree that the PI in your account will be evaluated and collected for the purpose of using the services. By creating this account, you also give us your consent to evaluate your shopping behavior, that is, which products you have bought, which products you have viewed. If you have registered, you agree that your user behavior on the website www.japonskenoze.sk. will be assigned to your customer account so that we can provide you with this personalized content (e.g. special events and information). However, if you have changed your mind and do not want to continue being registered, you can delete the registration in your account. You can shop at www.japonskenoze.sk. at any time even as an unregistered buyer, i.e. a guest.
4. THE THIRD PARTIES
Your personal data may be provided to third parties. During the processing of the order and fulfillment of the purchase contract, data is also provided to third parties such as carriers, couriers, banks and the like. The buyer's personal data are processed only for the purpose of fulfilling the contract and for the necessary time. Third parties: Direct Parcel Distribution SK s.r.o. (IČO 35 843 198) - Forwarding Agreement and Agreement on the processing of PD vibration s.r.o. (IČO 46 409 157) - Contract for work and Contract for the provision of services, License contract and Contract for the processing of personal data In the case of the purpose mentioned in point 2.3, PD may be provided in matters of suspicion or proceedings on misdemeanors and in criminal offenses by members of the Police Force during the performance of duty, performing clarification, investigation, verification or operational investigation in the matter to which the data obtained by the camera system relates.
5. YOUNGER THAN 16 YEARS OF AGE
In connection with the offer of information society services, the operator processes personal data legally based on the consent of the person concerned, if the person concerned has reached the age of 16. This e-shop is not directly intended for persons under the age of 16. The operator does not process personal data of persons under the age of 16. At each registration/login, the operator requests a sworn statement from the buyer. This e-shop is not intended for purchases by persons under the age of 16.
6. ESTIMATED DEADLINES FOR DELETING PERSONAL DATA
The buyer agrees to the processing of personal data from the date of granting consent in accordance with these terms and conditions for a period of up to 10 years in fulfillment of the purpose of performance from the contract par. 2.1. on the basis of a special law (e.g. on accounting). In the case of exercising the right of the affected person to delete personal data in accordance with par. 23 of Act no. 18/2018 Coll. the operator will delete the PD after exercising the right within 1 month after exercising this right. PD according to par. 2.3 are disposed of by automatic deletion of digitized data stored by the camera system on the internal recording medium, which also includes personal data without the intervention of an authorized person. The liquidation of PD obtained by the operation of the camera system is ensured automatically, by the program operation of the system. If the created record is not used for the purposes of criminal proceedings or misdemeanor proceedings, the record is automatically deleted by the system's program activity within 30 days from the day following the day on which the record was made, unless a special law provides otherwise.
7. TRANSFER TO A THIRD COUNTRY
In order to provide the Newsletter service (information about news and promotions), the operator uses the MAILCHIMP electronic service operated by The Rocket Science Group, LLC 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, Georgia 30308, USA (which joined the Shield for the Protection of PD between EU and USA - "Privacy Shield" only in the scope of the e-mail address).
8. AUTOMATED PROFILING
In order to improve the quality of marketing campaigns, the operator uses automated profiling. By profiling, we segment the offer/s that may interest you and are more advantageous for you. In the case of profiling, we use the Google Adwords system. Consent is not required for the basic collection of statistical data, e.g. by using the Google Analytics measurement code.
9. IP ADDRESS
An IP address is a set of numbers that uniquely identifies a device in a computer network. From the point of view of personal data protection, the IP address can be classified as data relating to an identifiable person. An IP address becomes personal data if: it is processed by the internet connection provider together with other identification (name, email...). static IP addresses used by natural persons / individuals must be considered as personal data. the dynamic IP address will be considered personal data in the event that the online service provider processes other identifiers considered personal data (e.g. first name, last name, email, etc.) together with the dynamic IP address. In the case of storing the IP address on the website (e.g. the WordPress editorial system for comments), it is necessary to choose a suitable processing purpose or use pseudonymization.
10. SECURE DATA TRANSFER
Your personal data is transmitted securely thanks to encryption. The SSL (Secure Socket Layer) coding system is most often used for secure communication with web servers. Personal data in our systems as well as the website are secured by appropriate technical and organizational measures against loss, destruction, alteration and further dissemination of data by unauthorized persons. If you are also registered on our website www.japonskenoze.sk, only you have access to your account, so make sure that you handle this data confidentially. The operator is not responsible for unauthorized loading or misuse of the password.
11. RIGHTS OF THE PERSON CONCERNED (buyer)
The buyer has the right in terms of the GDPR to (i) the right to correction, (ii) the right to erasure, (iii) the right to data portability, (iv) the right to object, (v) the withdrawal of consent, (vi) the right to access information. Right to rectification. The buyer has the right to have the operator correct incorrect PD that concern his person and supplement incomplete PD without undue delay. Right to erasure. The buyer has the right to have the operator delete the PD that relate to it without undue delay. The operator is obliged to delete these PD without undue delay if any of the following reasons are met: The personal data are no longer necessary for the purpose for which they were obtained or processed, the person concerned revokes consent to the processing of personal data for at least 1 specific purpose, consent is invalid if its provision is precluded by a special regulation, the person concerned objects to the processing of personal data and there are no overriding legitimate reasons for processing personal data, it concerns direct marketing, including profiling, PD are processed illegally, the reason for erasure is the fulfillment of an obligation under this Act, a special regulation or an international treaty to which the Slovak Republic is bound, or were obtained in connection with the offer of information society services and the person concerned is under 16 years of age. If the operator has published personal data and is obliged to delete them, he is also obliged to take adequate security measures, including technical measures, taking into account the available technology and the costs of their implementation, in order to inform other operators who process personal data of the person concerned about his request for these operators to delete references to its PD and their copies or write-offs. Right to data portability. The person concerned has the right to obtain the PD that concern him and which he provided to the operator in a structured, commonly used and machine-readable format and has the right to transfer these PD to another operator - seller, if it is technically possible and if: PD are processed on the basis of the consent of the person concerned, on the basis of the contract and on the basis of the consent of the person concerned, which is invalid if its provision is excluded by a special regulation, processing of PD is carried out by automated means. The right to object The buyer has the right to object to the processing of personal data relating to him for the purpose of direct marketing, including profiling to the extent that it is related to direct marketing, the operator is obliged to explicitly inform the affected person of his rights at the latest at the first communication with him, while information about this right must be listed clearly and separately from any other information. The buyer can exercise his right to object by automated means using technical specifications.
- Withdrawal of consentThe buyer has the right to withdraw consent to the processing of personal data concerning him at any time. The withdrawal of consent does not affect the legality of the processing of personal data based on consent before its withdrawal; before giving consent, the buyer must be informed of this fact. The buyer can revoke the consent in the same way as he granted the consent.You can withdraw your consent by clicking or by e-mail.Right of access to information.The buyer has the right to obtain from the operator a confirmation as to whether the PD related to it is being processed. If the operator processes such PD, the buyer has the right to obtain access to these PD and information about:for the purpose of processing the PD,category of processed PD - in our case, they are ordinary PD, the operator does not process a special category of PD,the identification of the recipient or the category of recipient to whom the PD were or are to be provided, in particular the recipient in a third country or an international organization, if possible,period of storage of the PD; if this is not possible, information on the criteria for its determination,the right to demand from the operator the correction of the personal data relating to the buyer, their deletion or limitation of their processing, or the right to object to the processing of personal data,just file a motion to initiate proceedings,PD sources, if personal data were not obtained from the buyer,the existence of automated individual decision-making, including profiling, in these cases the operator will provide the buyer with information in particular about the procedure used, as well as about the meaning and expected consequences of such processing of personal data for the buyer.Based on this request, the operator is obliged to provide information within 30 days from the delivery of this request. The operator can extend this deadline by another 60 days, we will inform you about the postponement.The operator may charge a reasonable fee corresponding to the administrative costs for the repeated provision of the PD requested by the buyer. The operator is obliged to provide the buyer's ID in the way he requested or according to his request.The operator reserves the right to verify the buyer and find out if it is a specific buyer. Verification consists in providing additional information, e.g. through control questions. Verification is important from the point of view of providing information about the PD that the operator processes.The right to submit a motion to initiate proceedings by the buyer.The buyer can file a motion to initiate proceedings in accordance with § 100 of the Act, if his rights are directly affected, the motion must include who is filing it, against whom the motion is directed, with the subject of the motion, indicating the rights that should have been violated during the processing of personal data, evidence.The sample proposal will be published on the website of the Office for Personal Data Protection, Hraničná 12, 820 02 Bratislava. The Office assesses the initiative within 30 days, makes a decision within 90 days, or may extend the deadline accordingly.
12. COOKIES
12.1 In accordance with § 55 par. 5 of Act NR SR no. 351/2011 Coll. on electronic communications as amended, we would like to inform you about the use of cookies and draw your attention to the possibility of changing the settings of your internet browser in case you are not satisfied with the current settings for the use of cookies. This policy contains information about how the operator uses cookies and similar technologies (hereinafter referred to as "cookies"). 12.2 What are cookies? 14. FINAL PROVISIONS
This information becomes valid and effective on May 25, 2018. The operator reserves the right to change these conditions in the event of a change in the company's processing of personal data and in the event of a legislative change.
